Welcome to Madar, a software platform provided as an online service to car-rental offices in the Sultanate of Oman, through which each office manages its branches, staff, fleet and contracts from a staff app and a web panel. These terms govern the relationship between Madar and each subscribing office and its users. By submitting an application or using the platform, the Office and its users agree to these terms and to the Privacy Policy, which forms part of them. If you do not agree, do not use the platform.
1. Definitions
- “Madar”, “we” or “us”: the operator of the platform.
- Platform: the website, the office web panel, the staff app and all related services.
- Office: a car-rental office or company whose application to join the platform has been approved and which uses the platform to run its business.
- Office owner: the person who submitted the application on the Office’s behalf and verified their mobile number, and who holds the widest permissions in the Office account.
- User: any staff member or other person for whom the Office creates an account on the platform, including the Office owner.
- Customer: a person who rents a vehicle from the Office and whose data the Office enters into the platform.
- Office data: everything the Office or its users enter into or upload to the platform, including customer data, contracts, vehicles, photos and documents.
- Subscription agreement: what Madar and the Office agree in writing regarding the plan, any fees, and the term, renewal and termination of the subscription.
2. Nature of the service and Madar’s role
- Madar provides technology tools that help the Office manage its branches, staff, fleet, rental contracts, inspections, handovers and returns, settlements, violations and reports.
- Madar is not a party to the rental contract between the Office and its customer, does not rent out vehicles, and does not act as an agent of the Office or of the customer. The relationship with the customer, including prices, insurance, deposits, refunds and complaints, is the Office’s sole responsibility.
- We may develop the platform by adding, changing or discontinuing features, and we will notify offices in advance of any material change that affects their use of it.
3. Application and approval
- The Office applies through the “Register your office” page on the website by entering the office name, its commercial registration number, the owner’s name and an Omani mobile number verified with a code sent on WhatsApp; it may also attach a copy of its commercial registration.
- The applicant confirms that they are authorised to represent the Office and that the information provided is accurate and complete, and undertakes to update it when it changes.
- The Madar team reviews the application. We may ask for additional information or documents before deciding, and then approve or reject the application. Submitting an application does not oblige Madar to approve it.
- The Office’s right to use the platform starts when its application is approved and its account is activated, and these terms apply to it from then on.
4. Subscription and fees
- This version of the platform includes no online payment, and no payment is requested when applying.
- The plan, any fees, the subscription term, the payment method and renewal are set by written agreement between Madar and the Office in the subscription agreement.
- If these terms and the subscription agreement conflict on fees, term or termination, the subscription agreement prevails to the extent of what it provides.
5. Accounts, roles and permissions
- Sign-in uses a mobile number and a verification code sent on WhatsApp, with no passwords. No user may share their code or device with anyone else.
- Each user has a personal account that no one else may use, and the Office is responsible for everything done through its users’ accounts.
- Six roles are available: owner, branch manager, rental agent, fleet officer, accountant and read-only. The Office owner can customise any user’s permissions and revoke their sessions and devices.
- The Office undertakes to give each user only the permissions they need for their work, especially the permission to view full ID numbers, and to deactivate without delay the account of any user who leaves or no longer needs access.
- The Office must tell us immediately if it suspects unauthorised access or if a user’s device is lost, and must revoke that device’s sessions from the office panel.
6. The Office’s obligations
The Office undertakes to:
- ensure that the data entered by the Office and its users is correct, accurate and up to date;
- make sure it has a lawful basis, and obtain the customer’s consent where the law requires it, before collecting ID, driving licence and passport data and images, vehicle photos and signatures, and inform its customers of how their data is processed;
- comply with the laws and regulations in force in the Sultanate of Oman, including those governing vehicle rental, traffic, consumer protection, tax and personal data protection, and hold the licences its business requires;
- take responsibility for its users’ actions on the platform as if they were its own;
- keep the records the law requires it to keep, using the export tools available in the platform to obtain copies of them.
7. Rental contracts and the Office’s terms
- The terms shown to the customer in the rental contract are the Office’s own terms, which it edits in its settings. Madar does not draft them or check their legality; the Office is responsible for them and is advised to review them with its legal adviser.
- Prices, insurance, deposits, mileage limits, late, fuel and damage charges and the other rental-policy values are set by the Office.
- The Office undertakes to show the terms to the customer before they sign, to verify the identity of the person signing, and to give the customer a copy of the contract on request or as the law requires.
8. Violations, damages and settlements
- The platform matches traffic violations to contracts by the vehicle’s plate number and the time of the violation only, and shows the result (one contract, more than one contract, no contract, or needs review). This matching is an aid and does not determine liability.
- The settlement on return is calculated automatically from the policy values set by the Office and from the results of the inspection carried out by its staff, and the Office must review it before charging the customer any amount.
- The Office alone decides liability for violations and damages and the amounts it claims from its customer, and alone bears the consequences of that decision towards the customer and the competent authorities. Madar is not responsible for any error in the data entered or in the policy values.
9. Integration with government authorities
- Government integration in the platform is a proposed concept and is not active. Madar does not currently send any data to any government authority, and any screens or statuses relating to this integration do not mean that data has actually been sent.
- The Office remains responsible for meeting any reporting or registration obligation that the law imposes on it towards the competent authorities, through their official channels.
- If a real integration is enabled later after approval by the competent authorities, we will inform offices in advance and update these terms and the Privacy Policy.
10. Platform security and data protection
We apply technical and organisational measures to protect Office data, including:
- isolating each office’s data from every other office, so that no office can see another office’s data;
- encrypting ID and licence numbers and showing them masked; viewing them in full requires a permission and is logged;
- keeping documents and photos in private storage that can only be opened through temporary links valid for 5 minutes;
- an audit log recording actions, who performed them and when;
- locking the app automatically after a period of inactivity with fingerprint or face unlock, and signing in with a WhatsApp code rather than passwords.
No protection is absolute, and the Office is responsible for protecting its users’ devices and the accounts it manages. The Privacy Policy explains how we process personal data: the Office is the controller of its customers’ data, and Madar processes that data on the Office’s behalf, on its instructions and only to provide the service.
11. Acceptable use
The Office and its users must not:
- share accounts or verification codes between people, or create an account for an unauthorised person;
- enter unlawful data, or data about people without a lawful basis, or use the platform for any unlawful or fraudulent purpose;
- attempt to access another office’s data, bypass permissions or security measures, or test the platform for vulnerabilities without our written permission;
- reverse engineer, copy, decompile or disassemble the platform or its apps, extract its data by automated means, or overload it with automated requests;
- upload malware or content that harms others or infringes their rights;
- resell, rent out or make the service available to anyone other than the Office without Madar’s written approval.
12. Intellectual property and Office data
- The platform, its software, design and trademark belong to Madar or its licensors. Throughout its subscription the Office receives a non-exclusive, non-transferable right to use the platform to run its business in accordance with these terms.
- Office data belongs to the Office, which grants Madar the right to process it only to the extent necessary to provide, support and protect the service and to meet legal obligations.
- We may use feedback and suggestions from the Office to improve the platform without any obligation towards it.
13. Service availability and support
- The platform is provided “as is” and “as available”. We make reasonable efforts to keep it available and secure, but it may occasionally be unavailable or delayed because of maintenance, connectivity or third-party services such as hosting, WhatsApp messaging and notifications; we work to restore it as quickly as possible.
- We do not guarantee that the platform is error-free or suits all of the Office’s needs, unless the subscription agreement sets a specific service level.
- Support is provided through the “Contact us” page on the website.
14. Suspension and termination
- Madar may suspend or restrict the Office’s account for a breach of these terms, the subscription agreement or the law, or to protect the security of the platform or other offices’ data. Suspension signs out all of the Office’s users and prevents them from signing in until it is lifted. We will tell the Office the reason for the suspension, in advance where possible, unless the law prevents it.
- Either party may end the subscription as provided in the subscription agreement.
- When the subscription ends, the Office may request an export of its contracts as a CSV file and then the deletion of its data, except what the law requires to be kept, as explained in the Privacy Policy.
- Provisions that by their nature should survive termination remain in force after it, including limitation of liability, intellectual property and governing law.
15. Limitation of liability and indemnity
- To the extent permitted by law, Madar is not liable for indirect or consequential loss, loss of profit or harm to reputation, for the accuracy of the data the Office enters, for the Office’s decisions towards its customers or disputes between them, or for accidents or damage involving vehicles.
- Unless the subscription agreement provides otherwise, Madar’s total liability for any claim does not exceed the total fees the Office paid to Madar in the twelve months before the claim.
- The Office indemnifies Madar against any claim by its customers, third parties or the competent authorities arising from the Office’s data, terms or decisions, or from its breach of these terms or the law.
- Nothing in these terms limits any liability that cannot lawfully be limited or excluded.
16. Changes to these terms
We may change these terms. We will notify offices of material changes through the office panel or the contact details registered with us a reasonable time before they take effect. If the Office continues to use the platform after they take effect, it accepts them; if it does not accept them, it may end the subscription under the subscription agreement.
17. Governing law and language
- These terms are governed by the laws of the Sultanate of Oman, and the courts of Muscat have jurisdiction over any dispute arising from them, after an attempt to settle it amicably.
- These terms are written in Arabic and English; if the two texts differ, the Arabic text prevails.
18. Contact
